DUIThe City of Virginia Beach in Virginia has been reported to be a top ranker in a recent study of cities with the highest number of drivers with DUIs on their record, a recognition not worthy of celebration.

According to the research of QuoteWizard, a Lending Tree company, Virginia Beach garnered the top 10 spot. This comes as no surprise since the commonwealth attorney’s office has admitted that, for years, drinking and driving has always been a huge issue in the city.

Interventions of the City

With the DUI arrests rising at an alarming rate each year, the city has utilized various resources to find and charge those who decide to drink and drive.  The Virginia Beach Police Department has established DUI checkpoints, a special operations traffic safety unit, as well as a fatal crash team that employees 10 officers on rotation for DUI enforcement duty. The department has been granted financial support from the Department of Motor Vehicles (DMV), funds that are spent on overtime pays of 30 officers dedicated to strictly enforcing DUI laws.

Other institutions have also taken it upon themselves to educate people on the dangers of drunk driving. Case in point is a local high school that prepared a tableau where a mock deadly car crash was highlighted, with students as actors.  The brutal and bloody scene was set up with damaged cars and students acting as car crash victims. To make it even more realistic, local first responders even arrived at the scene taking “car crash” victims in a body bag, an ambulance, and a helicopter. The objective of the activity was to leave a realistic impression on teenagers about the dangers of drinking and driving.  Also part of the program is for students to visit emergency rooms, the courthouse, the jail and the morgue and find out firsthand what happens after a DUI car crash.

Virginia Beach’s DUI Enforcement

Virginia Beach has committed to prosecuting DUI violators to the fullest extent of the law. The commonwealth attorney’s office has maintained a strong stand against accepting any plea deals for DUI cases. Although the court system in Virginia Beach is fair, they have a record of high conviction rates and harsh penalties. There is zero tolerance for DUI and violators will even get an earful from the judge who will lecture them of the dangers that they have put themselves and other people in because of drinking and driving.

The basic law in Virginia Beach is no different from other DUI laws in the country: drivers may not drive while intoxicated or under the influence of alcohol or drugs. A blood alcohol concentration (“BAC”) of 0.08 or greater is already considered “under the influence”. Moreover, even if your BAC is below 0.08,  you may still be found guilty of violating the law if it appears that alcohol or drugs have impaired your driving. DUI is also known as DWI or “driving while impaired” or “ “driving while intoxicated” which is defined as “when any person has consumed enough alcoholic beverages to ‘so affect his manner, disposition, speech, muscular movement, general appearance or behavior, as to be apparent to observation.”
